KanitThai provides a range of Services through the Platform, including but not limited to, enabling you to purchase merchandise products like home decor,accent pieces, tableware, gift items and souvenirs, etc., and receive the benefits of KanitThai's service, including payment processing, transaction handling, packaging, order fulfilment, and customer service ("Services").

Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, KanitThai owns all Intellectual Property Rights to and into the website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know how, trade secrets, goodwill, source code, meta tags, databases, text, content graphics, icons and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the website belonging to Kanit Thai without obtaining prior authorization from it.

The site contains copyrighted material, trademarks, and other proprietary information, including, but not limited to text, software, photos, videos, graphics, music, sound, etc.Users may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Except as otherwise expressly stated under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material without the express permission of Kanit Thai is permitted.

Order cancellation by KanitThai

Due to unavoidable circumstances, there may be times when certain validly placed orders may not be processed or dispatched. KanitThai reserves the exclusive right to refuse or cancel any order for any reason. Such situations that may result in your order being cancelled shall include limitations on quantities available with us, inaccuracies or errors in product or pricing information, problems identified by our credit or fraud avoidance department, or any defect regarding the quality of the product. In case products ordered are totally or partly unavailable, the buyer will be informed accordingly by e-mail within a period of 5 to 6 working days about the total or partial cancellation of their order. In such case, the buyer will be refunded the price for the unavailable products within 30 days from the date of such intimation to the buyer. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card/debit card/any other mode of payment has been charged, the said amount will be reversed into the source of payment within a period of 30 working days.

Payment

The price of our merchandise as mentioned on KanitThai.com is the Maximum Retail Price (MRP) for the said product, inclusive of all taxes as applicable in India.

We accept all major debit and credit cards (including Mastercard, Visa and American Express) and also provide Net Banking options across major banks.

While availing any of the payment methods offered by us, we are not responsible for taking any liability in respect of any loss or damage arising directly or indirectly to you, including but not limited to the following : (a) lack of authorization for any transaction; (b) exceeding the present limit mutually agreed by you with your bank; (c) payment issues arising out of the transaction; (d) decline of transaction for any other reason.

KanitThai may employ third party payment processor for payments on the website. Use of such services will be governed by their user agreement, seller terms, conditions, rules and policies as applicable. We are not responsible for any error by the payment processor.

All payments made against the purchases on KanitThai.com shall be in terms and conditions of third party online payment gateway services as applicable to your transaction as approved by KanitThai. Before shipping your order to you, we may request you to provide supporting documents, including but not limited to government issued identity and address proof, to establish the ownership of the payment instrument used by you for the purchase. This is done to ensure safe and foolproof online shopping for our users.

Late Delivery/Loss in Transit

KanitThai endeavours but does not guarantee delivery of products in the time period mentioned in the website. In no manner can the contract be repudiated if KanitThai fails to deliver any or all the products within the mentioned time period. However, if you fail to take delivery of the goods, you may be charged shipping cost for return of goods.

Product Description

Products displayed on KanitThai.com attempts to be as accurate as possible. However, KanitThai.com does not warrant that product descriptions or other content is accurate, complete, current or error-free.

Since each piece is handmade, items may differ slightly from picture depicted on website. Product colour may be at slight variance due to photographic lighting sources. The colours of products depend on your monitor and may not be properly displayed. Actual object may vary from images in terms of form and colour due to diverse screen resolutions and device settings.

Information on our website may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. KanitThai reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.

Cancellation of Order

In case of requests for order cancellations, KanitThai reserves the right to accept or reject requests for order cancellations for any reason. As part of usual business practice, if we receive a cancellation notice and the order has not been processed/ approved by us, we shall cancel the order and refund the entire amount. We will not be able to cancel orders that have already been processed. KanitThai has the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by KanitThai and accept KanitThai's decision regarding the request for cancellation.

Warranties and Liability

All information, content, material and products made available by KanitThai are provided on 'As Is' and 'As Available' basis, unless otherwise specified in writing. KanitThai does not make any representation or warranty of any kind, express or implied, as to the operation of the services, or the information, content, material, products, etc.,unless otherwise specified in writing. You expressly agree that your use of the website is at your sole risk.

Though KanitThai shall make all endeavours to protect its website from any viruses or other illegal use of its website, we do not warrant that this site or its content or services are free of viruses or other harmful components.

Please note the standard warranties and the conditions of usage of the products in relation to each product. No claim (a) that is contrary to the above, or (b) where products have been used contrary to the conditions of usage, will be entertained.

Indemnity

You agree to indemnify and shall not hold KanitThai responsible for any claim or demand, including but not limited to reasonable legal fees, or arising out of or related to your breach of these terms and conditions, or your violation of any law or the rights of a third party or any damage to life and/or property caused by the products delivered.

Any person who is found to be in breach of the Terms of Use or Privacy Policy can be refused access to this website.

If you breach the Terms of Use or Privacy Policy or other rules and policies, we reserve the right to recover any amounts due and owing by you to us and to take strict legal action, but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.

You agree to indemnify, defend and hold harmless KanitThai from and against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by KanitThai that arise out of, result from, or may be payable by virtue of, any breach of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these supply terms or any additional terms applicable to the purchase of products.

In no event shall KanitThai and its partners, directors, or employees be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not KanitThai has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your purchase of products and services herein. Notwithstanding anything to the contrary, Kanit Thai's entire liability to you under these Terms shall be the refund of money charged from you, under which the unlikely liability arises.

Force Majeure

Failure on the part of Kanitthai to perform any of its obligations shall not entitle you to raise any claim against KanitThai or be a breach under the Terms and Conditions of Service if such failure arises from an event of Force Majeure. If through Force Majeure the fulfillment by either party of any obligation set forth in this Agreement is delayed, the period of such delay will not be counted in computing periods prescribed by this Agreement. Force Majeure will include any war, civil commotion, strike, governmental action,lockout, accident, epidemic or any other event of any nature or kind whatsoever beyond the control of KanitThai that directly hinders or prevents KanitThai from commencing or proceeding with consummation of the transactions contemplated hereby.
